Courts in Polk County
Which court hears what, where each one sits, and the number to call. Polk County's courts share one building — the Judicial Center at 101 West Mill Street — except the two municipal courts and the justices of the peace out in the precincts.
PolkTX cannot tell you which court your matter belongs in, cannot look up a case, and cannot help you fill in a form. Every court below has its own clerk, and that is who to ask. If you cannot afford a lawyer, Lone Star Legal Aid is listed at the bottom because the county's own courts list it.
District courts
Felonies and the larger civil matters. Both Polk County district courts sit in the Judicial Center and publish a combined calendar.
258th Judicial District Court
A three-county district. Court for Polk County is held at the Judicial Center. The court requires a setting request for every setting, emailed to the court coordinator, and asks that settings be confirmed with that office. Its judicial conduct notice is worth reading before you contact it: judges cannot take private communication about the merits of a pending case, and neither can their staff.
411th Judicial District Court
Shares a combined calendar and standing criminal orders with the 258th. Setting request form and local rules are on its page.
County courts
Between the district courts and the justice courts. This is where most misdemeanours, probate and guardianship matters are heard, and where an appeal from a JP or municipal court lands.
County Court at Law
Hears Class A and B misdemeanours, appeals from the justice of the peace and municipal courts, probate and guardianships. It also shares jurisdiction with the district courts over family law, juvenile matters, CPS cases, civil matters over $500 and up to $325,000, and delinquent tax collection and tax lien foreclosure. Settings are made by emailing a completed setting request form to the court — no date is given until the form arrives.
Constitutional County Court
The court the County Judge presides over, alongside running the Commissioners Court. In Texas the county judge is an elected administrator as much as a judicial officer, and this seat is on the November 3 ballot.
Justices of the peace
Four precincts, four courts, four elected judges. Small claims, evictions, debt claims, traffic and Class C misdemeanours — and the court most people will actually stand in.

Its page publishes the fees: $54 to file an eviction, debt claim or small claim, $100 per person served, and $205 for a writ of possession covering two hours. Call for anything else.
Justice of the Peace, Precinct 4
Municipal courts
City courts, for city citations and city ordinance violations. An appeal from one goes to the County Court at Law.
Livingston Municipal Court
Open Monday 8 to noon and 1 to 7, Tuesday to Thursday 8 to noon and 1 to 5, Friday 8 to noon and 1 to 3, as the city publishes them.

Created by the legislature in 1915. It takes appeals from the district and county courts at law of the ten counties in its district.
